| Dear all. I have been reading up on different types of mortgages, as they can occur, and have seen several mentions of so called equitable mortgages, or mortgages over equitable rights. Can someone please tell me what this means exactly? Thanks very much for your time and effort! Kind regards. |

| This is an uncommon form of mortgage, which sometimes arises, or can actually be set up in such a way from the beginning. Depending on the country, or jurisdiction, in question such mortgage can occur in different circumstances. In fact, it is possible such mortgage will occur if a legal mortgage was never perfected to convey the underlying assets. A mortgage over equitable rights is such a contract as a trust, for instance. |
