Land lord did a deduction on my rent deposit! Can he do that?

I'm a tenant in my current place for three years, since I got to university. I had a roommate but he is about to leave. He made a damage in the kitchen and our landlord have seen it. He requested his part of deposit but he didn't get it, neither did I. Land lord did a deduction on my rent deposit! Can he do that?

| Landlord has more rights to keep your deposit then you thought. Legal protection of rent is not very well regulated, unfortunately for you. The main reasons are leaving the house in bad condition, not paying rent, not repairing or replacing anything damaged or any breach of the agreement. Make sure that you did everything that your contract demands and that you didn't brake any other rule. When leaving, you should arrange a joint inspection with a landlord to avoid any misunderstanding. Something is damaged so you have an obligation to replace or repair it and if it's not done your landlord can do a deduction. The question is did he has the right to take all of it. Maybe only a part of it should be deducted and you should get an explanation on that. Call him and ask what is the reason. You should do something about that damage if you want your deposit back. If any problems show up remember that proofs are not on your side. |
