Hello,
At my company weve been having some trouble with ex-employees being poached by the competition. They are then using their knowledge from our firm to get ahead, and steal clients. Is it a solution to get employees to sign a Non-Disclosure Agreement? What can this really do? I would like to know to what extend such an agreement is binding, and how it works out in practice. What if the agreement is broken? Thanks for your comments. |

| These NDAs are definitely of help in preventing indiscretion on the part of employees and ex-employees. Yes, they are legally binding, and you can sue if the agreement is breeched. But on the other hand, if someone wants to, he or she can surely find a way of hiding the fact that they were responsible for the spread of certain trade secrets. |
