Stamp Duty and Transfer of Equity to Wife

| I am seriously considering making a significant transfer of equity to my wife, with whom I am married under the regime of "total separation of assets". whilst I have already donated by hand a number of valuables to her, in the case of the remaining items I would feel happyer if proper deeds were registered so as to provide "certain date" - essential in the case of inheritance taxes. What's your view on this? |

| The answer to your question varies of course enormously depending on where the transaction occurs. In the US, it will even vary between individual states. Fortunately, in the European Union this is not the case any longer, except on a temporary or "transitional" basis for the newer or "recently joined" member states. The general rule is that the stamp duty is a cost recovery exercice charged by the authorities and not a tax. So it would normally be applicable, but hey, check with your friendly tax adviser! |
