| Hello. I recently received a notice of intended prosecution from a debt collector regarding my debt. Two days later, this individual called my house and argued with my wife. Now, he keeps calling me and I'm starting to feel like he's harassing me. He's constantly asking me where I work, and keeps pushing me to send them money. With his irritating attitude, I'm feeling depressed, and I even don't want to pay them anything! What should I do if he calls me again? Can he really sue me? Can I send my attorney to negotiate with him? |

| Well, the answer to your question is yes! Some types of collection practices are prohibited, and they can't make phone calls at unreasonable time. But, it is not against the law to be rude. If he threatens you, or calling you names, that's harassment and it is against the law. Debt collector has no authority to decide to take any legal action against you; this kind of a decision can be made only by your creditor. Collector can only recommend a legal action, but the decision is on your creditor. You should show a responsible attitude and try to negotiate with your creditor. You can provide evidence concerning your current financial situation and try to negotiate reasonable payments in an amount you can afford. Legal representative with debt collection experience can be very helpful in this situation. |
